Privacy policy
To create an account, you need to provide an email, a username and a password. You may also complete your player profile with some other data, and data is generated by your use of the service.
This data is stored and processed for the purpose of providing the BGA service:
_ We are using cookies (see below), otherwise you would need to choose a language and enter your password each time you browse a page on BGA.
_ Your password is stored encrypted, but the usual precautionary measures apply. You should use a strong password and not use the same one that you use for any other sensitive website (or any other website, if you want to be particularly cautious).
_ Chat discussions are stored during a maximum of 11 weeks, for moderation purposes. Moderators - who are other players we selected among the community - may have access to any chat discussions from the past 11 weeks, which is necessary as 80% of the moderation actions relate to insults or aggressive behavior in the chat. If you are worried about this, we remind you to consider that all your chat discussions on BGA are public.
_ We don't share or sell your data with third parties without your consent. Your consent may be implicit in some obvious cases (such as if you take part in a contest with prizes from a publisher, as some information will be needed for the publisher to contact you to redeem the prize).
_ Your profile information is visible to other players, as well as your gaming history on the website. So, since anyone can create an account on the site, it should be considered public information. If you use a pseudonym for your username, it could help to keep your real identity private (in case you would be worried about that).
_ For administration, moderation, improvement of the BGA service and technical purposes, complementary data can be collected from technical sources (browsers, networks, etc.) and cross referenced with publicly or commercially available datasources.
_ Automated processing is used for the purpose of providing a personalized service (such as suggesting games the user might like, or personalized communication). No further automated decision making or profiling specific to the user is undertaken beyond this scope.
_ This data is stored and processed as long as you keep an account on the service. Upon deletion of your account, data directly linked to your identity is deleted. Remaining data necessary for maintaining the service for other users is thus disjointed from your identity while maintaining the rights of other users to data that is collectively created.
_ You can exercise your rights about your data by sending us a request in writing through our contact page.

By using our Services, you are agreeing to these terms. Please read them carefully.
Using our Services
You must follow any policies made available to you within the Services.Don’t misuse our Services. For example, don’t interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.
Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Don’t remove, obscure, or alter any legal notices displayed in or along with our Services.
Our Services display some content that is not from BGA. This content is the sole responsibility of the entity that makes it available. We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please don’t assume that we do.
In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of some of those communications.
Your BGA Account
You may need a BGA Account in order to use some of our Services. You may create your own BGA Account, or your BGA Account may be assigned to you by an administrator, such as your employer or educational institution. If you are using a BGA Account assigned to you by an administrator, different or additional terms may apply and your administrator may be able to access or disable your account.
To protect your BGA Account, keep your password confidential. You are responsible for the activity that happens on or through your BGA Account. Try not to reuse your BGA Account password on third-party applications. If you learn of any unauthorized use of your password or BGA Account, please change it immediately from your preferences.
Your responsibilities as a BGA player ("the Player")
The Player is solely responsible for any message, content and information posted by him on the site since, in its capacity as host of the service considered here, under the provisions of French Law No. 2004-575 of 21 June 2004 on confidence in the digital economy, BGA cannot be held responsible for the content posted or transmitted by Players on the Site and on which BGA exercises no control and monitoring.
The Player expressly agrees, under penalty of criminal responsibility or civil liability, that the messages and content he will post on the Site are not likely to (without this list being exhaustive):

_ Harass other players with whom the Player would be contacted when discussing the different communication areas of the site;
_ Promote or encourage any criminal activity or enterprise;
_ Solicit and / or disclose passwords and / or personal information for commercial or unlawful purposes;
_ Transmit any chain e-mails, unsolicited mass mailings, instant messages, commercials or unwanted unsolicited mail;
_ Contain advertisements and / or solicitations to offer products and / or commercial services through the Site;
_ Contain addresses or hypertext links to external sites whose content is contrary to the laws and regulations, which violate the rights of others or is contrary to these terms.
The Player agrees to hold only one account on BGA, unless otherwise approved by BGA. We reserve the right to terminate any multiple accounts attributable to the same person.
The Player agrees not to resort to the use of automated systems such as scripts to play or send messages.
The Player is solely responsible for the keeping and confidentiality of their password and agrees not to communicate it to any other player or to use the account, the username and password of another Player.
The Player guarantees the accuracy of information provided to BGA for purposes of registration and agrees to notify any subsequent changes.
The Player acknowledges that BGA reserves, in case his use of the site would be contrary to these Terms or to generally applicable laws and regulatory provisions, the right to - immediately and without notice - deregister him from the Site services and / or to block his access to the Site.
BGA reserves, assuming the Player would be responsible for an offense under the legislation or for affecting the rights of third parties, the right to provide, upon request of any legitimate authority (courts, administrative authorities, police), all information allowing or facilitating the identification of the offending Player.
The Player is required to notify BGA, using the "Report this player" function, of any misuse of the Site of which he has knowledge, including any message whose contents violates the above prohibitions or more generally applicable laws and regulatory provisions.
About audio/video chat
BGA offers optionnal audio/video communications during games. The usage of these features are conditioned by the explicit acceptance of additional terms by each player.
Any interaction between players in a real time audio/video chat room is private to and the sole responsability of those players.
Board Game Arena doesn't record real time chat activity, but you should be aware that any player in the chat room has the possibility to make such recordings. Thus, you shouldn't do or say anything that you wouldn't want on record (or on a public video service).
This audio/video communication features are restricted to ADULT players according to the laws of each player country, or requires that each user received explicit permission to use this service from an adult legally responsible.
Board Game Arena won't be liable for any inconvenience or damage directly or indirectly linked to the use of this service.
Privacy and Copyright Protection
BGA's privacy policies explain how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that BGA can use such data in accordance with our privacy policies.
We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers according to the process set out in France and the European Union.
If you think somebody is violating your copyrights and want to notify us, you can contact us directly though our "Contact" section.
BGA uses cookies. Cookies are stored on the computer of the subscriber, to record information relating to the navigation of the computer on the Site (such as pages viewed, date and time of visit, etc.) that BGA can read during subsequent visits. This allows for easier navigation and avoids having to provide at each new visit information that was already sent at an earlier date. It is stated that the shelf life of "cookies" created by BGA is less than 6 (six) months. BGA notifies the Player that the settings of his browser allows him to be alerted of the presence of "cookies" and to disable the use of "cookies" should he want to do so.
Your Content in our Services
Some of our Services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours.

About these Terms

Conditions générales de ventes
Ces conditions générales de ventes sont une traduction en Français des "Term of Sales" du service (accessibles ci-après), proposée en application de l'article 2 de la loi n°94-665 du 4 août 1994. BGA fournit un service d'abonnement personnalisé ("Abonnement Premium") qui permet à ses membres d'accéder à du contenu et des fonctionnalités supplémentaires.

Abonnement
1.1 BGA offre deux types d'abonnements Premium:
_ des "Abonnements": des adhésions qui sont renouvellées, période après période, jusqu'à ce qu'elles soient stoppées par l'utilisateur, avec une période de facturation explicite (ex: annuel, mensuel).
_ des adhésions simples, pour une période explicite donnée (ex: 1 an, 6 mois, 2 mois).
1.2. Votre Abonnment Premium est prolongé, période par période, jusqu'à ce qu'il soit stoppé. Pour utiliser votre abonnement Premium, vous avez besoin d'un accès Internet, d'un terminal compatible avec BGA, et de nous fournir un moyen de paiment valide. "Moyen de paiement valide" signifie un moyen de paiement courant, valide et accepté par notre service, qui doit éventuellement être mis à jour de temps en temps, et qui peut nécessiter le recours à un service tiers. Tant que vous n'annulez pas votre abonnement avant la fin de votre période de facturation actuelle, vous nous autorisez à prélever le prix d'abonnement de la période suivante en utilisant votre moyen de paiment (voir "annulation" ci-dessous).

1.4. Certains abonnements peuvent avoir différentes périodes de facturation (1 mois, 6 mois, 1 an), conditions ou limitations, qui vous sont présentées lors de leur souscription ou autre communication qui vous sera rendu accessible. Vous pouvez obtenir les détails spécifiques concernant votre abonnement Premium en visitant notre site et en cliquant sur le lien "Premium" accessible depuis le menu principal, ou en visisant la section "Preferences / Mon compte".
Facturation, Annulation, Rétractation
2.1. Cycle de facturation: Le prix d'adhésion à l'abonnement BGA Premium, ainsi que tout frais supplémentaires que vous pouriez encourir lors de votre utilisation de notre service tel que des taxes ou des frais de transaction, sont prélevés sur une base périodique en utilisant votre moyen de paiement, le jour calendaire correspondant au début de votre abonnement payant. Dans certains cas, votre jour de paiement peut être modifiée, par exemple si votre moyen de paiement n'a temporairement pas pu être prelevé ou bien si votre abonnement a débuté un jour qui n'existe pas dans le mois courant. 100% du prix de chaque période est facturé au début de chaque période (ex: une fois par an pour l'abonnement "annuel").
Article L215-1 du code de la consommation:
Pour les contrats de prestations de services conclus pour une durée déterminée avec une clause de reconduction tacite, le professionnel prestataire de services informe le consommateur par écrit, par lettre nominative ou courrier électronique dédiés, au plus tôt trois mois et au plus tard un mois avant le terme de la période autorisant le rejet de la reconduction, de la possibilité de ne pas reconduire le contrat qu'il a conclu avec une clause de reconduction tacite. Cette information, délivrée dans des termes clairs et compréhensibles, mentionne, dans un encadré apparent, la date limite de non-reconduction.
Lorsque cette information ne lui a pas été adressée conformément aux dispositions du premier alinéa, le consommateur peut mettre gratuitement un terme au contrat, à tout moment à compter de la date de reconduction.
Les avances effectuées après la dernière date de reconduction ou, s'agissant des contrats à durée indéterminée, après la date de transformation du contrat initial à durée déterminée, sont dans ce cas remboursées dans un délai de trente jours à compter de la date de résiliation, déduction faite des sommes correspondant, jusqu'à celle-ci, à l'exécution du contrat.
Les dispositions du présent article s'appliquent sans préjudice de celles qui soumettent légalement certains contrats à des règles particulières en ce qui concerne l'information du consommateur.
Article L215-3
Les dispositions du présent chapitre sont également applicables aux contrats conclus entre des professionnels et des non-professionnels.
Article L241-3
Lorsque le professionnel n'a pas procédé au remboursement dans les conditions prévues à l'article L. 215-1, les sommes dues sont productives d'intérêts au taux légal.
2.2. Méthodes de paiement: Pour obtenir un abonnement BGA, vous devez fournir un ou plusieurs moyen de paiement. Vous pouvez mettre à jour vos moyens de paiment en allant sur la page "Premium". Nous pouvons aussi mettre à jour vos informations de paiement en utilisant des informations fournies par nos fournisseurs de services de paiements. Après ces mises à jour, vous nous autorisez à continuer à prélever les moyens de paiments correspondants. Vous nous autorisez à prélevez n'importe lequel des moyens de paiement que vous avez spécifié si votre moyen de paiement principal n'est plus disponible pour le paiement du prix de votre abonnement. Vous restez redevable de tous les montants non collectés. Si un paiement échoue en raison d'une date d'expiration, de fonds insuffisants ou autre, et si vous ne suspendez pas votre abonnement, nous pouvons suspendre votre accès au service Premium tant que nous n'avons pas réussi à prélevez votre moyen de paiement. Pour certains moyens de paiement, l'emetteur du moyen de paiement peut vous facturer certains frais, tels que des frais de change ou d'autres frais relatifs au fonctionnement de votre méthode de paiement. Des taxes locales peuvent varier en fonction de la méthode de paiement utilisée. Merci de prendre contact avec l'émetteur de votre moyen de paiement pour plus de détails.
2.3. Annulation. Vous pouvez annuler votre abonnement Premium BGA à n'importe quel moment, et vous pouvez continuez à avoir accès au service BGA Premium jusqu'à la fin de votre période de facturation. Dans la mesure de ce qui est autorisé par la loi, les paiements sont non-remboursables et nous n'effectuons pas de remboursements ou de crédits sur les périodes d'abonnements partiellement utilisées, en raison de problèmes techniques ou en raison de décision liés à la modération du service. Pour annuler votre abonnement, allez sur la page "Premium" et suivez les instructions pour l'annulation. Si vous annulez votre abonnement, votre compte sera automatiquement basculé vers un compte "Gratuit" standard à la fin de votre période courante de facturation. Pour voir quand votre compte sera basculé vers un compte standard, cliquez sur "Voir mon profil" dans le menu utilisateur en haut à droite, puis regardez l'information "Premium jusqu'à -date-".
2.4. Modifications de prix et d'abonnement. Nous pouvons modifier les abonnements disponibles et les prix de notre service de temps en temps; cependant, toute modification du prix de nos abonnements ne pourra vous être appliqué avant une période de 30 jours suivant une information qui vous sera envoyée.
2.5. Rétractation: en application de la loi Française (L.221-18 du code de la consommation), tout abonnement BGA Premium souscrit par un client Français peut être remboursé sans retenue durant une période de 14 jours qui suit le paiement initial, sur simple demande à "contact@boardgamearena.com". Nous ne faisons qu'un seul remboursement par utilisateur et par moyen de paiement.
Contenu et fonctionnalités de BGA Premium
3.1. Vous devez être agé de 18 ans ou plus, ou de l'âge correspondant à la majorité dans votre pays, pour devenir un membre de BGA Premium. Les mineurs peuvent uniquement utiliser le service sous la supervision d'un adulte.
3.2. Le service BGA Premium et tous les contenus accédé à travers le service sont pour votre usage personnel et non-commercial, et ne doit pas être partagés avec des personnes en dehors de votre foyer. Durant votre abonnement nous vous accordons un droit limité, non-exclusif, non-transférable à accéder au service BGA Premium et son contenu associé.
3.3. Le service BGA Premium fourni l'accès à des "Jeux Premiums". La liste complète des "Jeux Premiums" est disponible sur la page "Premium". Chaque jeu "Premium" a besoin d'au moins 1 membre Premium pour démarrer. Autrement dit, les joueurs Premiums peuvent créer des nouvelles tables de jeu Premium, et jouer avec n'importe quel autre utilisateur de BGA, Premium ou non.
3.4. Le service BGA Premium fourni l'accès à des "Extensions Premiums". Les "Extensions Premiums" sont des options (cad: des variantes) d'un "jeu de base". Un jeu avec une "Extension Premium" a besoin d'au moins 1 utilisateur Premium pour démarrer. Autrement dit, les joueurs Premiums peuvent créer des nouvelles tables avec une option "Extension Premium" sélectionnée, et jouer avec n'importe quel autre joueur de BGA, Premium ou non.
3.5. BGA affiche de temps à autre une publicité en début de partie. Cette publicité n'est pas affichée aux membres BGA Premium, leur permettant un accès direct au jeu.
3.6. Une table de jeu avec au moins un membre Premium BGA n'a pas de restriction liée à la position géographique des joueurs. Autrement dit, si au moins un membre BGA Premium est à une table de jeu, les autres joueurs jouant depuis le même emplacement peuvent jouer à la même table.
3.7. Les membres BGA Premium ont aussi accès aux fonctionnalités suivantes:
_ discussions en direct audio / video avant, durant et après les parties.
_ accès illimités aux pages de statistiques, incluant les statistiques de fin de parties et les autres statistiques sur les joueurs.
_ couleurs préférées: pour une liste limitée de jeux (comme indiqué sur la page "Premium"), et si la couleur est disponible, BGA attribue au joueur Premium sa couleur préférée, tel qu'il l'a indiqué dans "Préférences / Préférences de jeu".
_ créer des nouveaux tournois (seuls les membres BGA Premium peuvent créer des tournois).
3.8. Le service BGA, incluant le catalogue de jeu, la liste des jeux Premiums, et les fonctionnalités du service, sont régulièrement mises à jour. BGA teste en permanence des nombreux aspects de son service, incluant le site internet, l'interface utilisateur, les fonctions promotionnelles, et ainsi de suite.
Divers
4.1. Loi applicable. Ces conditions générales doivent être régies et interprétées en vertu des lois Françaises. Ces conditions ne limitent pas les protections dont vous bénéficiez en tant que consommateur d'après la loi de votre pays de résidence.
4.2. Support client. Pour obtenir plus d'information sur notre service et ses fonctionnalités, ou si vous avez besoin d'assistance avec votre compte, merci de visiter les forums BGA, la FAQ BGA ou la page Contact BGA sur notre site.
4.3. Survie. Si une ou plusieurs dispositions de ces conditions générales devait être rendu invalide, illégale ou irrecevable, la validité, la légalité ou la recevabilité des autres dispositions resterait intacte.
4.4. Communications électroniques. BGA vous envoie les informations relatives à votre compte (ex: autorisations de paiemnt, factures, modification de mot de passe ou de moyen de paiement, messages de confirmation, notice d'information) sous forme électronique uniquement, par exemple via emails à l'adresse email que vous avez fourni durant votre inscription.

The following terms are applicable to Board Game Arena "Premium" membership.
BGA provides a personalized subscription service ("Premium membership") that allows our members to get additional content and features.
These Terms govern your use of our service. In these Terms of Use, "Premium", "BGA Premium", "our service" or "the service" mean the personalized service provided by BGA as described in https://boardgamearena.com/premium page (and below).
Membership
1.1 BGA offers two kinds of Premium membership plans:
_ "Subscriptions": membership plans that continue period-to-period until terminated, with an explicit billing period (ex: yearly, monthly).
_ Simple membership plans for an explicit given period of time (ex: 1 year, 6 months, 2 months).
1.2. Your BGA Premium "Subscription" membership will continue period-to-period until terminated. To use the BGA Premium service you must have Internet access and a BGA ready device, and provide us with one or more Payment Methods. "Payment Method" means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party. Unless you cancel your membership before your period billing date, you authorize us to charge your next period's membership fee to your Payment Method (see "Cancellation" below).
1.3. The simple membership plans ends at the end of the period of time associated to the plan. You are billed only once at the beginning of the period.
1.4. We may offer a number of membership plans, including special promotional plans or memberships offered by third parties in conjunction with the provision of their own products and services. Some membership plans may have differing billing periods (1 month, 6 months, 1 year), conditions and limitations, which will be disclosed at your sign-up or in other communications made available to you. You can find specific details regarding your Premium membership by visiting our website and clicking on the "Premium" link available at the main menu, or by visiting "Preferences / My account" section.
Billing, Cancellation, Withdrawal
2.1. Billing Cycle. The membership fee for the BGA Premium "subscriptions" service and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a periodical basis to your Payment Method on the calendar day corresponding to the commencement of the paying portion of your membership. In some cases your payment date may change, for example if your Payment Method has not successfully settled or if your paid membership began on a day not contained in a given month. 100% of the price of each period is billed at the start of each period (ex: once per year for the "yearly" subscription).
2.2. Payment Methods. To get a BGA membership subscription, you must provide one or more Payment Methods. You can update your Payment Methods by going to the "Premium" page. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s). You authorize us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the Premium service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.
2.3. Cancellation. You can cancel your BGA Premium membership at any time, and you will continue to have access to the BGA Premium service through the end of your billing period. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial membership periods, technical issues or moderation decision. To cancel your subscription, go to the "Premium" page and follow the instructions for cancellation. If you cancel your membership, your account will automatically switched to a standard "Free" account at the end of your current billing period. To see when your account will be switched to a standard "Free" account, click "See my profile" on your top right personal menu, and "Premium until -date-" section. You may also find billing information about your BGA membership by visiting your account with the applicable third party.
2.4. Changes to the Price and Subscription Plans. We may change our subscription plans and the price of our service from time to time; however, any price changes or changes to our subscription plans will apply to you no earlier than 30 days following notice to you.
2.5. Withdrawal: according the French law (L.221-28 1° du code de la consommation), any BGA Premium subscription can be refunded without penalties during a period of 14 days following the initial payment with a simple request at email "contact@boardgamearena.com". We only make one refund per user and per payment method. However, according to the same law, we recall the users that any use of any Premium features (including the simple viewing of a statistic) makes your subscription not refundable.
BGA Premium content and features
3.1. You must be 18 years of age, or the age of majority in your province, territory or country, to become a member of the BGA Premium service. Minors may only use the service under the supervision of an adult.
3.2. The BGA Premium service and any content viewed through the service are for your personal and non-commercial use only and may not be shared with individuals beyond your household. During your BGA Premium membership we grant you a limited, non-exclusive, non-transferable right to access the BGA Premium service and associated content.
3.3. The BGA Premium service is providing an access to "Premium games". The complete list of "Premium games" is provided on the "Premium" page. Each "Premium" game needs at least 1 Premium users to start. In other terms, Premium users can create new Premium game tables, and play with any other BGA user, Premium or not.
3.4. The BGA Premium service is providing an access to "Premium expansions". "Premium expansions" are options (ie: variation) of a "base game". A game with a "Premium expansion" option set needs at least 1 Premium users to start. In other terms, Premium users can create new tables with a "Premium expansion" option selected, and play with any other BGA user, Premium or not.
3.5. BGA is sometimes displaying an advertisement at the beginning of the game. This advertisement is not displayed for BGA Premium members, so that they get immediate access to the game.
3.6. A game table with at least one BGA Premium member has no restriction linked to players geographical location. In other terms, if at least one BGA Premium member is at a game table, other players playing from the same geographical place can also play at this table.
3.7. BGA Premium members also have access to the following features:
_ audio / video live discussion before, during and after games.
_ unlimited access to statistics page, including end of game statistics and other players statistics.
_ color preferences: for a limited list of games (as displayed on "Premium" page), and if the color is available, BGA is giving BGA Premium members their prefered colors, as specified in "Preferences / Game preferences".
_ creating new tournaments (only BGA Premium members can create tournaments).
3.8. The BGA service, including the games catalog, the Premium games list and the service features, is regularly updated. BGA also continually tests various aspects of the service, including the website, user interfaces, promotional features and so on.
Miscellaneous
4.1. Governing Law. These Terms of Use shall be governed by and construed in accordance with the laws of France. These terms will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence.
4.2. Customer Support. To find more information about our service and its features or if you need assistance with your account, please visit the BGA Forums, BGA FAQ or BGA Contact page on our website.
4.3. Survival. If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.
4.4. Electronic Communications. BGA will send you information relating to your account (e.g. payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example via emails to the email address provided during your registration.

Games are games and it's all up to publishers to make them relevant or accurate to history, or not.
We're focusing on gameplay and rules. We're not history books, nor an accurate source for anything related to real things.
BGA is against any bad behaviors on real people, and will never EVER join, talk or expose about anything about themes, history or politic.
